Student Discipline/Conduct These policies and procedures are reprinted from the AVC Board Policies, Section 5030. General Provisions The Board of the Antelope Valley Community College District shall suspend or expel students for misconduct when other means of correction fail to bring about proper conduct. No student shall be suspended or expelled unless the conduct for which he/ she is to be disciplined is related to college activity or college attendance. Violation of any law, ordinance, regulation, or rule pertaining to the parking of vehicles shall not be cause for suspension or expulsion of a student from the college. Disciplinary Measures Reprimand A reprimand is a warning that continued conduct of the type described in the reprimand may result in a subsequent formal action against a student by the district. Records of reprimand are destroyed two years after the last entry has been made relative to any disciplinary action against a student. Reprimands are not considered a part of the official record of the student. The college is not required to provide due process for students who receive a reprimand. Disciplinary Probation Disciplinary probation is a formal action of the district against a student for misconduct, and the action may result in the student being removed from all college organization offices and being denied the privilege of participating in all college or student sponsored activities, including public performances. Disciplinary probation may be imposed on a student for a period not to exceed one year. The college is not required to provide due process for students who are placed on disciplinary probation. Suspension Suspension is a formal action of the district against a student, and the action denies the student the right to occupy any portion of the campus, to attend any class, and/or to participate in any of the activities of the college for not longer than a period of two years. The suspension of a student must be accompanied by a hearing in front of the College Appeals Committee. Interim Suspension A single student, or a group of students, may be given an interim suspension by the president of the college when in his judgment such action is the most appropriate means available for alleviating the threat of a disorder which could prevent the continued normal conduct of the affairs of the academic community. Interim suspension imposes the same penalty as does regular suspension, except that interim suspension is limited to only that period of time necessary to ensure that the purposes of the interim suspension are accomplished, and in any case, for not more than a maximum of 10 school days. Should it appear necessary for an interim suspension to continue in effect over an extended period, a reasonable opportunity must be afforded the suspended person for a hearing before the College Appeals Committee within 10 days. Suspension by Ins truc tor An instructor may suspend for cause any student from his/her class for the day of suspension and the day following. The instructor shall immediately report the suspension to their dean and vice president of student services. A decision will then be made concerning further disciplinary action. The student shall not return to the classroom from which he/she was suspended, during the suspension, without the concurrence of the instructor, the instructors dean and the Vice-President of Student Services. No instructor shall be allowed to suspend a student without first apprising the student of the reason for suspension and permitting such student to present his/her version of the incident causing suspension. If the student is a minor, the instructor shall ask the parent or guardian of the student to attend a parent conference regarding the suspension as soon as possible. A college administrator shall attend the conference if the instructor or parent or guardian so requests. Expulsion Expulsion is a formal action of the district against a student, and the action denies the student the right to occupy any portion of the campus, to attend any class, and/or participate in any activities of the college indefinitely. Discrimination/Sexual Harassment In accordance with Title VII, Section 1604, and Title IX of the 1972 Education Amendments, it is the policy of Antelope Valley Community College District to maintain a learning and working environ- ment that is free from discrimination on the basis of race, color, national origin, sex (including sexual harassment), disability, or age in any of its policies, procedures, or practices. Policy/Complaint Procedure The policy regarding discrimination and sexual harassment as well as the Discrimination Complaint Form is contained in the districts Affirmative Action Plan, available in the Office of Human Resources. Students or employees with complaints of discrimination or sexual harassment should direct them to either the Affirm- ative Action Officer at (805) 943-3241, Ext. 258 or the Title 9 Officer at (805) 943- 3241, Ext. 266. Sex Discrimination Sex discrimination is defined as the differential treatment of students and staff within the college community on the basis of sex in employment, educational programs and activities. Sex discrimination examples in the treatment of students include, but are not limited to: admissions access to programs and facilities vocational education physical education competitive athletics graduation requirements student rules, regulations, and benefits treatment of married and/or pregnant students
